In accordance with Article L121-20-4 of the French Consumer Code, customers are reminded that they do not have the right of withdrawal, as provided for in Article L.121-20 of the French Consumer Code, when services are provided on a specific date or during a specific period. The cancellation conditions and their implementation are linked to the rates applicable to the booking and will be specified at the time of online purchase. Any failure by the Customer to show up at the hotel or ‘No Show’ (reservation not cancelled - customer not present) shall constitute cancellation of the entire reservation, implying the release of the reserved night(s) and automatically resulting in the total amount of the reserved stay being payable, i.e. all nights and extras reserved, without any right to reimbursement for the customer. In the event of interruption of the stay, the full price of the stay previously booked may be charged, or in some cases a ‘credit note’ corresponding to the unused portion of the stay may be offered to the Customer. I acknowledge that I have read these General Terms and Conditions of Sale before placing my order. Therefore, by placing an order, I fully agree to the General Terms and Conditions of Sale of the Ermitage Hotel and accept all of their provisions without reservation.
FORCE MAJEURE
The management of the Ermitage Hotel considers force majeure to be any event external to the parties that is both unforeseeable and insurmountable, preventing the hotelier or the customer from fulfilling all or part of their obligations under the contract. This shall apply in particular to general strikes affecting transport (upon presentation of proof), hotel staff, bad weather, riots and attacks, etc. It is expressly agreed that force majeure shall suspend the parties' performance of their mutual obligations. At the same time, each party shall bear all costs incurred by it as a result of the force majeure event: consequently, travellers shall bear alone any additional costs that may be incurred to enable the journey to continue.
DATA PROTECTION
In accordance with Law No. 78-17 of 6 January 1978 on data processing, files and freedoms, amended by Law No. 2016-1321 of 7 October 2016 for a ‘Digital Republic’ and in the context of compliance with the GDPR, which came into force on 25 May 2018, customers are advised that their order must be processed by name and by computer in order to be completed.
If customers refuse to provide their data, the Ermitage Hotel will be unable to process the reservation and will be forced to refuse to register the reservation, without this constituting a refusal to sell without legal basis. As a result, the Ermitage Hotel shall be released from any liability in this regard.
